Government proposes changes to the taxation of family foundations. Paczuski Taudul Partner Comments in Puls Biznesu

Following an earlier attempt to amend the taxation of family foundations, which was vetoed by the President last year, the government has returned with a revised draft bill. Experts have commented on the proposed reform and its potential tax implications in Puls Biznesu. According to Andrzej Paczuski, partner at Paczuski Taudul, the current proposals will not undermine the attractiveness of family foundations.

“Compared with the earlier proposals, the draft should be considered at least neutral for businesses. It does not eliminate the opportunities offered by family foundations or undermine their attractiveness. The main drawback of the draft, however, is the increase in the tax rate,” comments Andrzej Paczuski.

In the article, our expert analyzes the proposal to increase the tax rate from 15% to 19% on benefits paid by family foundations to beneficiaries, assets distributed upon the dissolution of a foundation, and so-called hidden profits. He also draws attention to the proposed increase in the tax burden through the application of the so-called minimum tax on buildings to family foundations.
